TERMS & CONDITIONS FOR FLOREO CREATIVE PROJECT SPACE & TOILET BLOCK HIRE 1. Floreo Creative agrees to allow the Hirer use of the project space (including outside toilet block) as per the agreed time and duration of the booking. 2. The Hirer agrees to pay Floreo creative as per the agreed amount for the time period. Cancellations and rescheduling are not permitted within 24hrs. 50% Refunds are given 7 days before the scheduled booking. Full refunds will be given for notice before this time and primarily at the discretion of Floreo Creative 3. Floreo Creative is not liable to the Hirer for any loss suffered by the Hirer arising out of the Hirer’s use of the project space. The Hirer releases the Floreo Creative from any claim made against Floreo Creative arising out of, in connection with, or caused by the Hirer’s use of the Floreo Creative project space. 4. The Hirer indemnifies Floreo Creative from and against all claims, demands, actions, costs, and expenses arising out of, in connection with, or caused by the Hirer’s use of Floreo Creative Project Space. 5. The Hirer agrees to effect public liability insurance for an amount of not less than $10 million per occurrence and to provide a Certificate of Currency to the Floreo Creative prior to commencement of the hire period. The Hirer agrees to keep the policy in force for the duration of the hire period. 6. The Hirer agrees to have and maintain a COVID SAFE Plan consistent with the requirements of Vic Health. 7. The Hirer agrees to reimburse Floreo Creative for the full cost of repairing any damage caused to the project space or facilities during the hire period. 8. The Hirer agrees to notify Floreo Creative of all injuries or damage arising out of the Hirer’s use of the project space within 7 days of becoming aware of the injury or damage. 9. The Hirer acknowledges receipt of the Conditions for Hire of the project space and agrees to those conditions. Hirer’s Liability a. The Hirer must not do or allow to be done on or in relation to the facility anything which may or does cause damage. b. Nothing permanent or semi-permanent is to be fixed to the walls, floors, curtains, or any part of the building, nor shall signs, scenery be erected without the express permission of the Booking Officer. Temporary attachments may be made using non-marking and non-damaging products such as “Bluetak”. c. Any damage, or cleaning of the facility if it is not left in the condition the Hirer found it in, as assessed by the Booking Officer, must be paid for within two weeks of notification to The Hirer. d. Should any damage occur, the Booking Officer’s assessment shall be final. e. Should the Hirer lose the keys and replacement locks or keys are necessary, liability for this cost will rest with the Hirer. Disputes a. In the case of any disputes arising, the decision of Floreo Creative will be final. Condition of Facility a. The Parish makes no warranty or representation to the Hirer about the condition of the Facility or its suitability for the Hirer’s purpose. b. The Hirer acknowledged that they have inspected the Facility and warrants that its suitable for the hirer’s purpose. c. The condition of the Facility should be left in the same condition as the hirer found it noting: 1. Chairs are to be stacked neatly; 2. All rubbish to be removed from the Facility; 3. All external doors are to be locked; Use of the Facility General a. The Hirer must not breach any of these Conditions of Hire. b. Use of The Facility by the Hirer is at the risk of the hirer at all times. c. No sales of any kind are permitted without prior approval. d. No Sub-letting of the Facility is permitted. e. Persons authorized by the Booking Officer for maintenance or Essential Services checks shall at all times be entitled to free access to all parts of the building. f. The Hirer is aware that the Facility is in a residential area and that all persons attending the Facility must refrain from any behaviour which could be reasonably construed as disturbing the neighbours or infringing on the person’s property and/or rights. g. The Hirer of the Facility and guests are confined to the Facility and its accompanying amenities. h. Floreo Creative accepts no responsibility for private property left in the Facility. Kitchen Facilities a. If kitchen facilities are to be used, all appliances must be left in a clean and tidy condition. b. No food or drink may be left in the Facility and/or accompanying amenities at the end of the hire period. c. All rubbish must be removed from the Facility and placed in the appropriate bins. d. Fridges are to be left on. Planned Activities/Entertainment a. Entertainment that is not in keeping with the values and standards of the Parish will not be permitted. b. Noise must be contained within the requirements of the council. Music must cease at midnight on Fridays and Saturdays, 10.00pm on Sundays and 11.00pm on all other days. c. It is the responsibility of the Hirer to obtain any necessary permits from the relevant authorities as required for planned activities. Alcohol a. Approval for the consumption of alcohol is at the discretion of the Booking Officer and must be requested by the Hirer if required. b. Under no circumstances shall liquor be sold until approval from the Booking Officer has been obtained and the necessary liquor permit is sighted at the time of obtaining the key to the facility. c. Approval for the consumption of alcohol may be withdrawn at the discretion of the Booking Officer. d. Normal liquor regulations apply. Alcohol is not to be served to guests under 18 years of age. Smoking Smoking is not permitted in the Facility.
